By accessing and using the Health-Net website or any of our healthcare administration services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
Health-Net ("we," "our," or "us") reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any changes indicates your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
Our Services
Health-Net provides Third-Party Administration (TPA) and healthcare management services, including claims administration, medical pre-authorization, provider network management, medical case management, utilization review, medical audit, and member support. Our Services are not a substitute for direct medical treatment; in a medical emergency, contact local emergency services immediately.
Administration Disclaimer
Health-Net administers healthcare benefits and coordination on behalf of insurers; we do not provide direct medical treatment. Coverage decisions are subject to the relevant insurance policy terms.
Service Availability
Services are subject to availability and geographic coverage across Iraq, the UAE, and Syria. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time.
User Responsibilities
When using our Services, insurers, providers, employers, and members agree to the following responsibilities:
- Accurate Information: Provide truthful, accurate, and complete information during enrollment, claims submission, and authorization requests.
- Account Security: Maintain the confidentiality of any account credentials and notify us immediately of unauthorized use.
- Lawful Use: Use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
- Respectful Conduct: Treat our staff and network providers with respect. Harassment, abuse, or inappropriate behavior will result in termination of services.
Claims, Billing & Reimbursement
Claims and reimbursements are administered in accordance with the applicable insurance policy terms agreed between Health-Net's insurance partners and their members. Network providers are reimbursed according to contracted tariffs. Disputes regarding claims or reimbursement should be directed to our provider relations or member support teams.
Intellectual Property
All content on the Health-Net website, including text, graphics, logos, and software, is the property of Health-Net or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent. The Health-Net name, logo, and associated visual identity are trademarks of Health-Net.
Limitation of Liability
To the fullest extent permitted by law, Health-Net and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services. Our total aggregate liability for any claim shall not exceed the amount of fees, if any, paid in connection with the specific service giving rise to the claim.
Health-Net provides its Services on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure, though we employ robust safety measures.
Indemnification
You agree to indemnify, defend, and hold harmless Health-Net, its affiliates, and their respective officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your violation of these Terms, your misuse of the Services, or your violation of any third-party rights.
Privacy & Data Usage
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect information. We adhere to applicable data protection and healthcare privacy regulations and maintain strict confidentiality of health records. By using our Services, you acknowledge our privacy practices and consent to the use of your data as described in the Privacy Policy.
Termination
We reserve the right to suspend or terminate access to the Services at any time, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, network providers, staff, or our business interests. Upon termination, the right to use the Services will cease immediately. Provisions related to intellectual property, limitation of liability, and indemnification shall survive termination.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Iraq, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the courts located in Erbil, Iraq, unless otherwise required by the laws of a jurisdiction in which the Services are provided.
